The Ritmic Warranty (formerly Elwing)

 

  • Legal guarantee of conformity
    • Definition

To comply with these GTC, the product must be suitable for the use normally expected of a similar product and, if applicable, for the use made of it:

- correspond to the description given by Ritmic and possess the qualities that the latter presented to the Customer;

- have the qualities that a Customer can legitimately expect considering the public statements made by Ritmic, notably in advertising or labeling;

Non-conformities appearing within twenty-four (24) months following delivery of the goods are presumed to have existed at the time of delivery, unless proven otherwise.

  • Implementation

The customer has the right to demand that the product complies with the contract. However, they cannot contest conformity by invoking a defect they knew or could not ignore at the time of the contract conclusion. The same applies when the defect originates from materials they themselves provided.

In case of non-conformity, the customer chooses between repair and replacement of the product.

When product replacement is impossible, the customer may return the product and get a refund or keep the product and get a partial refund.

The application of the provisions of articles L217-4 to L217-14 of the Consumer Code is carried out at no cost to the customer.

    • Article L217-4

The seller delivers goods that comply with the contract and is responsible for any non-conformity existing at the time of delivery.

They are also responsible for any non-conformity resulting from packaging, assembly instructions, or installation when this was assigned to them by the contract or carried out under their responsibility.

  • Article L217-5

The goods comply with the contract:

1° If it is suitable for the normal use expected of similar goods and, if applicable:

- if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model;

- if it has the qualities that a buyer can legitimately expect considering the public statements made by the seller, the producer, or their representative, notably in advertising or labeling;

2° Or if it has the characteristics mutually agreed upon by the parties or if it is suitable for any special use sought by the buyer, made known to the seller and accepted by the latter.

  • Article L217-10

1° If the requested, proposed, or agreed solution under article L. 217-9 cannot be implemented within one month following the buyer's claim;

2° Or if this solution cannot be without major inconvenience for them considering the nature of the good and the use they seek.

However, the cancellation of the sale cannot be pronounced if the non-conformity defect is minor.

The action resulting from non-conformity expires two years after delivery of the goods.

 

  • Warranty against hidden defects
    • Implementation

The Customer may, after prior formal notice to the site manager and attempt at amicable resolution, invoke the warranty for hidden defects.

  • Legal provisions - Civil Code
    • Article 1641

The seller is liable for the warranty due to hidden defects of the sold item that make it unfit for the intended use, or that so diminish this use that the buyer would not have acquired it, or would have paid a lower price, if they had known about them.

  • Article 1648

The action resulting from hidden defects must be brought by the buyer within two years from the discovery of the defect.

 

  • Manufacturer's warranty
    • What does the manufacturer's warranty cover?

The manufacturer's warranty covers all return costs for products purchased from one of our authorized dealers or on our website.

IMPORTANT: Our warranty is not valid outside the European Union.

 

    • Condition for coverage under the manufacturer's warranty

This warranty being exceptional, it applies in case of normal use of the products, without abuse or use outside the conditions for which the products are designed. We therefore count on the honesty of our customers.

 

    • Procedure for warranty coverage:

Our customer service will contact you as soon as possible to establish a remote diagnosis.

In most cases, the problem can be diagnosed remotely and therefore repaired quickly. We rely on the honesty of our customers regarding the cause of the failure.

 

 

    • In which cases can the manufacturer's warranty be refused?

Reminder of the commercial warranty law: "This warranty being a supplement to legal warranties, the manufacturer sets its own conditions."

We remind you that our goal is to best accommodate our customers to satisfy them. However, in the following cases, we will refuse to accept your product under the manufacturer's warranty:

  1. Lack of civility towards our team: Anyone showing disrespect towards our team will lose the manufacturer's warranty.
  2. Honesty: Anyone who has not told the truth about the origin of the defect and has wasted our team's time will be denied the manufacturer's warranty.
  3. Anyone who has deliberately damaged the brand, posted a negative review, or revealed their failure on social media without first contacting our customer service.
  4. Presence of water marks inside our components.
  5. Defect caused by a fall or any other event not related to a defect in the board.
  6. Damage during transport.


    • Parts covered by the manufacturer's warranty: 

For new electric bikes:

This warranty takes effect from the date of purchase. It is only granted for normal use of the bike. 

The frames and all components mounted on our bikes are guaranteed against manufacturing defects for a period of 2 years.

The battery is guaranteed to have a minimum residual capacity of 70% after 2 years or 500 full charge cycles (whichever comes first)*

The finishes are guaranteed against manufacturing defects for a period of one year from the date of purchase.

 

For new electric skateboards:

(The following list indicates items covered by the commercial warranty and not by legal warranties as they are assumed, by design, to be parts that degrade over time)


The battery: 2-year warranty or 500 cycles (whichever comes first)*

Remote control: 2-year warranty

Lights: 2-year warranty

 

For refurbished electric bikes and skateboards:

 

This warranty takes effect from the product delivery date. It is only granted for normal use of the product. 

The frames and all components mounted on our bikes and skates are guaranteed against manufacturing defects for a period of 1 year.

The battery is guaranteed to have a minimum residual capacity of 70% after 1 year or 250 full charge cycles (whichever comes first)*.
